Trademark Registration in India: Fees, Process and Timeline

Every marketplace, from Amazon to Zepto, asks for a trademark certificate or application receipt before treating you as a brand. Beyond marketplaces, a registered trademark is what stops a competitor from legally using your brand name. This guide covers the real fees, the online filing process, and the mistakes that delay registrations by months.

Why a trademark matters before you sell online

Amazon Brand Registry, Flipkart brand approval, and every quick commerce platform require either a registered trademark or a filed application. Without one, anyone can list lookalike products under your name and you have almost no legal recourse.

A trademark also protects your packaging, logo and brand name across India, not just where you operate today. For a brand planning to scale across marketplaces and quick commerce, it is the single cheapest legal protection available.

    Trademark registration fees in India

Government fees depend on who is filing. Individuals, startups and small enterprises pay Rs 4,500 per class for online filing. Companies and larger entities pay Rs 9,000 per class. Physical filing costs more. Professional fees for an agent or attorney are separate and typically range from Rs 2,000 to Rs 10,000 depending on the firm.

One application covers one class. A snack brand and a clothing brand need different classes, so a business selling in two categories files two applications. Choosing the right class matters: filing in the wrong class means your protection does not cover what you actually sell.

The online filing process, step by step

    • Create an account on the IP India e-filing portal
    • Run a public search for conflicting marks in your class
    • Prepare the application: mark, class, applicant details, and a user date if already in use
    • File form TM-A online and pay the government fee
    • Receive the application number immediately; you can use the TM symbol from this point
    • Respond to any examination report within the deadline if the registrar raises objections
    • Publication in the Trademark Journal, then registration if no opposition is filed

Timeline and what happens after filing

You get an application number the same day and can start using the TM symbol immediately. The registrar examines the application in roughly one to three months. If there are no objections, the mark is published in the Trademark Journal for four months of public opposition. If nobody opposes, the registration certificate follows.

Objections are common and usually fixable: a well-drafted reply to the examination report resolves most of them. Contested cases take longer, but even then the application itself already unlocks marketplace brand programs.

    Mistakes that delay registration

    • Filing in the wrong class and having to refile
    • Skipping the public search and hitting an obvious conflict
    • Claiming a user date you cannot prove with invoices or evidence
    • Missing the examination reply deadline, which abandons the application
    • Filing a logo and word mark together when separate filings protect better
